1. Acceptance of terms

These Terms & Conditions ("Terms") govern access to and use of the Zapsam website (zapsam.com), the Zapsam rider app, and the Zapsam partner app (together, the "Platform"), operated by Zapsam Mobility Technologies Private Limited ("Zapsam", "we", "us", "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Eligibility

You must be able to form a legally binding contract under Indian law to use the Platform. Partners must additionally hold all licences, permits, and documentation required by applicable law to operate the relevant vehicle category on the Platform.

3. Description of service

Zapsam operates a technology platform that connects riders seeking transportation with independent partners offering rides, starting in Hyderabad, Telangana. Zapsam is a technology intermediary — rides are provided by independent partners, not by Zapsam itself. Some categories, vehicle types, or features described across the Platform may be in planned or phased rollout and are not necessarily available in every location or at every time; where this is the case, we aim to make that clear at the relevant point in the app or website.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at admin@zapsam.com if you suspect unauthorized use of your account.

5. Rider obligations

• Provide accurate pickup and drop-off information.
• Treat partners with respect and behave safely during trips.
• Pay the fare shown/confirmed for a completed trip through the payment method used to book it.
• Not use the Platform for any unlawful purpose.

6. Partner obligations

• Hold and maintain valid licences, permits, insurance, and vehicle documentation as required by applicable law for the vehicle category operated.
• Provide accurate onboarding and verification information.
• Operate vehicles safely and in compliance with applicable traffic and transport regulations.
• Complete accepted trips in good faith and treat riders with respect.

Partners are independent contractors and are not employees, agents, or representatives of Zapsam Mobility Technologies Private Limited.

7. Fares and payments

Fares are calculated based on factors such as distance, time, vehicle category, and prevailing conditions, and are communicated to the rider through the Platform before or at the time of booking. 8. Prohibited conduct

You agree not to:

• Use the Platform for any fraudulent, unlawful, or harmful purpose.
• Interfere with or disrupt the operation or security of the Platform.
• Misrepresent your identity or provide false onboarding/verification information.
• Harass, threaten, or endanger any rider, partner, or member of the public.

9. Limitation of liability

To the maximum extent permitted by applicable law, Zapsam Mobility Technologies Private Limited shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable Indian law.

10. Suspension and termination

We may suspend or terminate access to the Platform for any account that violates these Terms, applicable law, or poses a safety risk to riders, partners, or the public, with or without prior notice where circumstances require immediate action.

11. Intellectual property

The Zapsam name, logo, app, website, and all associated content are the property of Zapsam Mobility Technologies Private Limited and may not be used without prior written permission.

12. Governing law and disputes

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts at Nizamabad, Telangana, India.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
